Question: If I file a petition to modify child support in March can I change my payments immediately or do I have to wait to hear back from the courts?
Answer: Once a petition to modify child support is filed, the court must assess whether the modification is necessary. The court will modify support if there are substantial changes in circumstances and such changes are continuing. A.R.S. § 25-327. It is in the court's discretion to decide whether the modification meets the statutory requirements. Simply petitioning for modification does not guarantee that it will be granted.
