Question: My wife left the state, and we have since filed for divorce. She has made no attempt to ask for the property she left behing. She has retained a lawyer in our state. Can I leave her belongings at the lawyers office?

Answer: Consider contacting your wife’s lawyer. Arizona is a Community Property state. This means that all property acquired by either the husband or wife during the time of marriage is community property and unless it fits under an exception is owned by both the husband and the wife.(ARS 25-211) For this reason, divorces in Arizona usually involve a Property Settlement Agreement where the husband and wife are able to decide what belongs to who and who will get what.
