Question: Is it possible to obtain legal guardianship of an unborn grandchild? The mother of the unborn child is my 16-year old daughter. The purpose of guardianship is to provide health insurance for the baby.
Answer:
As of now, in Arizona, the statutes do not provide for guardianships of unborn children. Just an FYI, in 2007 a house bill (HB 2437 ) was introduced to our state legislature. HB 2437 proposed amending the statutes to provide for guardianships of unborn children. Nothing further has been done with regard to this proposal. The law has not been changed.
