Question: my sister lives in AZ. She has a parenting agreement with babies father. He is abusive, in and out of jail for meth, and many other reasons she is trying to move back home to Indiana. Father says he will have her arrested if she leaves the state and she is scared, please help.
Answer: Depending on what the parenting agreement says regarding leaving with the child, she may be able to ask the court for a revision in the parenting plan. You may want to contact an attorney to see what options she has.Usually the parent moving over 100 miles must give a 60 day notice of move to other parent so that they can request hearing if wanted. Otherwise the person can move.
