Question: If i'm assaulted by a correctional officer and they claim asualt on them, do I have right to sue or press charges?
Answer: You can certainly sue if you believe you have a case to present, however, there is a big difference between being able to sue and being successful in the lawsuit. You would have to prove up the case and present evidence that you were assaulted. Charges could be filed, but again a prosecutor would have to make the decision that a case could be brought against the corrections officer.
