Question: I was arrested for disorderly conduct. I was not driving nor charged with a DUI. The police told the to take a breathalyzer or go to the hospital. I was examined and then taken to jail. The hospital is now billing me for $800. Is that bill not the state's responsibility?
Answer: That would depend on the examination and the purpose of the examination. If the exam was for law enforcement purposes, such as a blood draw, then the police department should be responsible. If, however, the officers took you to the hospital because of a health concern for you, then you would likely be responsible. It is difficult to say for certain without information as to why the examination was performed, and the type of examination.
