Question: Am I entitled to evidence that was taken if charges were not filed by the D.A.
Answer:
If it is something that is illegal, you wont get it back. Ultimately, you would need to contact the property bureau of whatever police department collected the evidence (since that is most likely where it is located). There are a lot of factors that go into this, such as if they plan to collect more evidence and re-submit charges, etc.
