Question: In 2013 I got charged with drug paraphernalia, I never went to court do I had a warrant out. In 2018 it got dismissed after 5 year review.. I recently got in trouble and have a court date coming up soon, is there any chance they can reopen and charge me for the case in 2013?

Answer: Short answer to your question: maybe. Long answer: In Arizona, possession of drug paraphernalia is classified as a Class 6 Felony pursuant to A.R.S. 13-3415. The time limitation for bringing a charge (known as the "statute of limitations") for a felony in Arizona is 7 years pursuant to A.R.S. 13-107. The time limits begin from the date you allegedly committed the crime, not the date of arrest or charging. The limit can be extended for periods in which you were living out of the state. In order to figure out if you could be re-charged with the drug paraphernalia charge, you need to determine if 7 years have passed since the exact date you were alleged to be in possession of the paraphernalia.
