Question: I signed my lease when I was 17 years old and I turned 18 a month later. I signed with no co-signer and I was wondering if it is possible for me to void my lease because I initially signed when I was 17 but I'm 18 now.
Answer: It definitely could be argued that a rental agreement executed by a minor is invalid or at least voidable. The Arizona Residential Landlord and Tenant Act expressly states that “the law relating to capacity to contract” supplements its provisions (A.R.S. 33-1303). However, if the matter ever went to court, other factors, including whether and for how long you have continued to reside in the dwelling under the terms of the original rental agreement after turning 18, would likely also be considered.
