Question: I'm on 2 yrs unsupervised probation. When can I apply for early release? What's the procedure. Superior court, Maricopa county. Po isn't helping.
Answer:
Per Arizona Revised Statute 13-901(E) the court may terminate probation early on its own initiative or if the defendant asks the court. A.R.S. 13-901. To terminate the probation early, the defendant will need to file a Petition for Termination of Probation. It is important that the defendant pay all fees, restitution, and have no violations of probation. The court will also look at several other factors when deciding whether or not to terminate a probation sentence early. For more information please consult an attorney. Veterans who meet the income eligibility requirement can receive a free consultation with an attorney. Please call our Legal Learn line at (866) 637-5341 for more information.
The Maricopa County Superior Court also offers Veterans Court for certain felony offenses where the defendant is placed on probation. If a veteran qualifies for Veterans Court, he or she will be placed on a specialized court docket and will be assigned a probation officer who was also in the military and has knowledge with issues that veterans face and can offer resources to help veterans. The Maricopa County Superior Court currently only accepts veterans with honorable discharges.
