Question: My dad has a violation warrant and has to appear in court on new charges, will the courts take me into custody?
Answer: Generally, the police may only take you into custody when you are under arrest. If the police believe you have committed a crime they may place you under arrest and then take you into custody. However, the police might want to ask you some questions regarding your dad. You do not have to be in custody for the police to ask you questions. You have the right to remain silent and to speak with an attorney whether or not you are in custody.
