Question: Can my former spouse elect to receive less than her previously awarded share of my military retirement in a modification?
Answer: If you both agree on this issue, you can go back to court, jointly request the decree of dissolution be modified to reflect the change you want. Most likely, your ex would need to either execute an affidavit or testify to the judge that she is willing to agree to the reduction in her share of your pension.
