Question: we are getting conflicting answers we need to know specifically : Is the ladlord responsible for paying trash service? we know they have to provide cans
Answer:
Generally, under the Arizona Residential Landlord and Tenant Act , the landlord and tenant may include in a rental agreement terms and conditions not prohibited by this chapter (chapter 10 of Title 33) (see, for example ARS 33-1315) or any other rule of law including rent, term of the agreement and other provisions governing the rights and obligations of the parties, see ARS 33-1314.
Looking over the lease agreement may be helpful to decide what each parties obligations are. Sometimes, depending on what type of community a person lives in (i.e., mobile home park, condominium, and apartment), there may be a specific Arizona statute that deals with specific requirements a landlord and tenant must do. For example, if a person lives in a mobile home park, according to ARS 33-1314.01, a landlord may charge separately for removal of waste, garbage, rubbish, refuse and trash and for sewer services, see in full ARS 33-1413.01 .
However, not all communities contain specific language in their statutes. For example, for an apartment complex, the landlord tenant act found in Title 33, Chapter 10 contains a statute that says that a landlord shall provide and maintain appropriate receptacles and conveniences for the removal of ashes, garbage, rubbish and other waste incidental to the occupancy of the dwelling unit and arrange for their removal. Therefore, looking at the lease agreement may be the best option for finding out the responsibilities of the landlord, as well as the tenant.
