Question: Over the past few months my apartment has been having serious plumbing issues. I have sewage coming up into my tub and when it is really backed up I cannot even flush the toilet. I am also unable to use my washer or shower due to the backup. My landlord who rents two apartments is taking his time handling the problem and refuses to use professionals to make the repairs and refuses to rent us a hotel. I read that the next step is to call the health department. Would that only make the problem worse. Is my landlord able to evict me in retaliation. My lease is good up to January.

Answer: Under A.R.S 33-1491 a landlord may not retaliate against a tenant who complains to a government agency about concerns of health and safety. http://www.azleg.gov/ars/33/01491.htm
