Landlord and Tenant Rights and Responsibilities
questions & answers
Question: Yesterday a beehive found its way into the eves over my front door, making it impossible to go in or exit from the front door. My wife (sadly the owner’s daughter. Not on good terms any longer) is highly allergic to bees. We have a restraining order on the landlord (father) so have little contact with him. We sent him a text to alert him of the bees. He refused to do anything that day and said he will need to get estimates, forgoing the risk this put o my wife. We found a company that came out the same day. We waiting several hours for him to comply but her refused. Are we liable for this fee
Answer: Yes, unfortunately you are liable for these fees. Under A.R.S. 33-1361 if the landlord fails to maintain the premises of the dwelling the tenant can provide written notice of the complaint (email, text message, standard mail, etc.). Once the complaint has been received the landlord has 10 days to comply, if he does not you can either pay for it and take it out of the following month’s rent, or you can break your lease giving a five day notice and move out. Even though your situation was an emergency, the landlord still has the right of 10 days to take proper action. http://www.azleg.gov/FormatDocument.asp?inDoc=/ars/33/01361.htm&Title=33&DocType=ARS
