Question: I returned part of my tenants deposit because their dog wet on the carpet. We took pics and the carpet person said it was pet urine. My question is how long do I have to give the tenant to cash the check before I can stop payment? It has been over a month since they received it.
Answer: If you sent them the amount you owed them, they do not have a time limit to cash the check. If you stopped payment on the check, you would, in essence, not be returning their rightful portion of the deposit and would be subject to suit by the tenant who may be entitled to the full deposit plus twice the amount improperly withheld. Taking no action on the check is your best direction now.
