Question: I signed a year lease this past Aug, but I'm having to leave the state to enter a substance abuse treatment center. Can I break my lease by invoking the American Disability Act?
Answer: This is for informational purposes only, you may want to consult an attorney for legal advice. Landlord/tenant relations are governed by the Arizona Landlord and Tenant Act. Unfortunately, there is no provision in this act that allows a tenant to breach a lease because of disability on behalf of substance abuse treatment. A tenant may breach the lease after material noncompliance of the lease agreement by the landlord, if the tenant is in the armed forces and being deployed, and other reasons.
