Question: My boyfriend and I moved in together at his parents house... They welcomed me with no lease and no conditions. 5 months later they want me and my boyfriend out that day so they throw us out. Do we have tenants right?
Answer: A formal written lease is not a requirement for the creation of a landlord/tenant relationship. However, if a resident has not paid periodic (e.g. regular monthly) rent in exchange for the right to live within a dwelling, then, as a general rule, no tenancy has been established, and the resident is considered to be a guest. This is especially true if the resident is a relative of the owner of the dwelling.
