Question: I know my building managers,are retaliating against me.i have been heare for 4 years,this is the first time manager told me that I don't have to sign my lease,I ask to sign my lease,she said no ,no need to cause I have singed the ttp rent calculation for the year 2017,is this legal,please help ,I don't know what to do,I don't think this is legal.i have done nothing wrong/elegal.thanks inavance for your advice.
Answer: If you have signed a new lease each year and your landlord now says that doing so is unnecessary, you may wish to remind your landlord that residential tenants in Arizona have the right upon request to have a copy of any current written rental agreement. Under Arizona law, landlords must deliver a signed copy of the rental agreement to the tenant and the tenant must sign and deliver to the landlord one fully executed copy of the rental agreement within a reasonable time after the agreement is executed (A.R.S. 33-1322). As to the issue of retaliation, under Arizona law, landlords are required to exercise their rights and responsibilities in “good faith” (A.R.S. 33-1311). They are also expressly prohibited from taking retaliatory actions in response to their tenants’ complaints (A.R.S. 33-1381).
