Question: My apartment needs repairs I put in the work order online they mark it as complete but it Dosent get fixed nothing does and I have taken pictures of the problem and have spoken with maintenance now I have mold in my complex and the repairs are still not done it's been months I have to keep putting in the same work orders again and again can I get out of my lease
Answer: I always recommend consulting the Arizona Residential Landlord and Tenant Act found here: https://housing.az.gov/sites/default/files/documents/files/AZ%20Residential%20Landlord%20and%20Tenant%20Act%20-%20Revised%20July%203%202015.pdf Under A.R.S. 33-1324(A) (in the link above), the landlord is required to maintain the premises. You can see the specific requirements in the link above if you scroll down and read 33-1324. If the landlord is in violation of 33-1324(A), you turn to 33-1361. It requires you to give the landlord written notice of what they need to fix and say specifically that if those items are not fixed within 10 days of the date of receipt of the notice (serve it on them personally or deliver it by certified mail return receipt), that your lease will terminate. If the breach is something "materially affecting health and safety" (no A/C in the summer, no water, for example), that period of time can be reduced down to 5 days. But you must give notice, must be specific about what needs to be repaired, and must wait the time period in 33-1361. If they fix it within the timeframe, you are still in the lease. If they don't fix it, the lease is terminated pursuant to 33-1361. Please note that I am providing general information based on the very limited information available to me.
