Question: I went to court on the 17th on the judgment was that I had to be out by 23 May so does that mean that I had there going to lock my apartment on the 23rd or does that mean that they can send the paperwork to lock my apartment on the 23rd when do I need to be out of my house . The judgment says immediate possession of the premises 1829 N. 45th Ave., Phoenix, AZ right of restitution to issue after five calendar days from this date right to issue on 05/23/2017

Answer: After a court has ordered the eviction of a tenant (A.R.S. 33-1377), the landlord must wait for 5 days before the landlord may ask the sheriff to enforce the writ of restitution and physically remove the tenant from the premises (A.R.S. 12-1181), which is supposed to happen “as promptly and expeditiously as possible” thereafter (A.R.S. 12-1178). In other words, as soon as the 5-day period has ended, the tenant is at risk of being removed immediately.
