Question: I have lived in the current house for 3 1/2 years. First 2 years we signed a lease. When it came time to sign a 3rd one the landlord said after 2 she doesn't require any more and we would just go month to month. We're have never been late. 6 months ago she raised our rent $125 to $1350. Now today she sent a text saying rental rates have gone up and starting next month she is raising it by $600 up to $1950. Nothing is that high in the area. I am a long haul truck driver. Only home 3 days a month. Don't know how I am going to be able to find a place, pack, and move in 3 days. Is this legal?

Answer: Unfortunately, when the tenant and the landlord have a month-to-month rental agreement, the landlord may propose to raise the rent to any level so long as a landlord provides the tenant with at least 30 days’ written notice prior to the beginning of the next rental period (A.R.S. 33-1375(B)). (In other words, if a landlord wishes to increase the rental amount beginning October 1st, then the tenant must be given notice, and the right to either accept the new amount or begin making plans to move out, before September 1st.)
