Question: My lease expires on Sept 30th, which is a Sunday. The property management company says I have to be out on Friday the 28th with no walk through,or, Thursday the 27th if I want to be present at the walk through. Is this true?
Answer: As a general rule (unless the rental agreement between the landlord and the tenant states otherwise), a tenant whose rental agreement expires at the end of the month may move out on that date (at the latest). If the rental agreement says nothing and the landlord insists that the tenant leave early, then the tenant may wish to ask the landlord for compensation in advance for the additional days for which the tenant paid rent but will not be residing in the dwelling as well any additional costs that the tenant will face before the tenant’s next rental agreement begins. Under Arizona law, a tenant has a right to request a move-out walk-through (A.R.S. 33-1321(C)).
