Question: The law provides that if my landlord does not return my deposit less deductions within 14 working days they are liable for damages of twice the amount of the deposit. Does that prevent the landlord from having any deductions at all?
Answer: Under A.R.S. 33-1321(D), the landlord must provide an itemized list of deductions from the security deposit (if any) along with the amount of the security deposit still owing (if any) within 14 business days of receiving a written request from the tenant. A landlord who fails to do so theoretically gives up their right to make deductions – but it will be up to the tenant to sue and win in court.
