Question: When a duplex is sold, does an existing lease insure that the price will not increase? What percentage can a new property owner increase the rent payment, upon legal ownership? A lease has been requested and not received, any recourse for the tenant?
Answer: As a general rule, during an agreed-upon tenancy period the monthly rent amount may only be altered by the landlord with the consent of the tenant, but as soon as that tenancy period ends (for example, when the year covered by the written lease comes to a close and the landlord gives the tenant notice that the lease will not be renewed without a rent increase) then the landlord may increase the rent, by whatever amount the market will bear.
