Question: My mother died sept 27. She had a will leaving her home to we three kids. Can we get a title change with this will so the property can be sold
Answer: You will need to follow the legal procedures defined by Arizona law. First, you will need to get at least one certified copy of your mother's death certificate. A death certificate is required to change deeds, titles and account ownership. You will also need to probate the Will and get the personal representative (executor) appointed. Are there liens or mortgages on the house? Are there other assets to be divided? Are the siblings all in agreement on how to proceed? You may benefit from consulting an attorney. There are 3 programs in Arizona that you can use to get some inexpensive legal advice and guidance. One is the Modest Means Program. If you are financially qualified for the program, for a $75 fee, Modest Means offers a one hour consult with an attorney. If you need additional help and the attorney agrees to take your case, the fee charged will not exceed $75 per hour. The telephone number is (866)637-5341.
