Question: there seems to be a question about smoking weed inside a renal condo complex where smoking inside is against the rules of Hoa. Have been told that it's ok if one has a medical card, but I can't be around the smoke and I smell it regularly.
Answer: Under the Arizona Residential Landlord and Tenant Act, a tenant is legally required to “conduct himself and require other persons on the premises with his consent to conduct themselves in a manner that will not disturb his neighbors’ peaceful enjoyment of the premises” (A.R.S. 33-1341). If the manner or location in which one tenant is smoking is bothering that tenant’s neighbor, then that neighbor may wish to ask the landlord to ask the tenant who smokes to smoke in some other way or elsewhere.
