Answer: Absolutely. Arizona Revised Statutes, Section 33-1364 requires landlords of residential dwelling to maintain a fit and habitable premises and all essential service including water and cooling. Your remedies are also spelled out in the Residential Landlord/Tenant Act. The statute requires you to give written notice of the lack of water and cooling to the landlord. The letter must be served on the landlord either by mailing it certified mail/return receipt requested or by hand delivering the letter to an authorized agent of the landlord. If you hand-deliver, keep a copy for your records and document who you gave it to and when. The landlord then has 5 days to remedy the situation. If it is not fixed, you can void the lease and move out.
