Question: I own my house and rent a lot in a "over 55" community. The driveway is a poor shape and I have asked management for several years for repair. Half of the driveways in the community have been repaired, and I have been told that the rest will be done shortly. That was three months ago! There are chips and holes in the driveway making a safety issue. How can I get them to uphold their responsibility? I do not want to move and just want them to provide the maintenance they are obligated to.
Answer: Under the Arizona Mobile Home Parks Residential Landlord and Tenant Act, mobile home park landlords are required (among other things) to “make all repairs and do whatever is necessary to put and keep the premises in a fit and habitable condition” (A.R.S. 33-1434(A)). A tenant who wants their landlord to make required repairs as is their landlord’s obligation under A.R.S. 33-1434(A) may wish to deliver to their landlord a signed and dated letter (keeping a copy for the tenant’s own records) identifying the problem in detail and requesting that the problem be fixed as soon as possible.
