Question: Recently signed a lease on an apartment, upon moving in found that there is no heat in the unit, even though is AZ, it gets cold at night in the winter. Is a landlord required to provide heat in a unit?

Answer: Under the Arizona Residential Landlord and Tenant Act, a landlord is required (among other things) to “comply with the requirements of applicable building codes materially affecting health and safety” (one of which is “adequate heating”); “make all repairs and do whatever is necessary to put and keep the premises in a fit and habitable condition”; and “supply . . . reasonable heat . . . when required by seasonal weather conditions . . .” (A.R.S. 33-1324).
