Question: I’m need of biohazard clean up after a very unfortunate accident that look place in our apartment. I’m aware that the cleanup close is somewhat covered through our renters insurance but the cost of cleanup is more then what they want to cover. My question is, I does this not fall on the management to help take care of this??
Answer: Under the Arizona Residential Landlord and Tenant Act, a landlord is generally required to “make all repairs and do whatever is necessary to put and keep the premises in a fit and habitable condition” (A.R.S. 33-1324) – unless the tenant or a guest of a tenant caused the problem or made the problem worse either “deliberately” (on purpose) or “negligently” (through carelessness) (A.R.S. 33-1341). Responsibility is assigned on a case-by-case basis.
