Question: If I am renting a unit for $550 utilities included. And the day of my son's birthday a real estate agent who claims to be the property manager comes to my door Saying I had to remove my kids portable kiddie pool. It was 6 ft wide 10 in deep. On my porch next to my front door. She serves me for days later with a notice to terminate lease agreement due to material non-compliance. If there's nothing in the least stating I can't use a kiddie pool. Is this document legal?
Answer: Type of pool does not matter if your lease prohibits you from having a pool. Landlord can terminate your lease for having any type of pool if prohibited by lease. You need to remove pool within the time requested in the landlord's notice or your lease can be terminated. If lease does not prohibit you from have pool,and having on front porch does not violate any government rules/regulations, then landlord does not have basis for evicting you. Generally, a pool (any type) on a front porch open to the public will likely be considered an attractive nuisance if someone get hurt. Hope this helps!
