Question: Can a landlord still evict me if I pay the full amount on the court summons before the court date?
Answer: BEFORE an eviction case is filed the rental agreement may be reinstated if the tenant pays past due rent and a reasonable late fee (as set forth in the written rental agreement). AFTER an eviction case is filed in order to reinstate you must pay past due rent, reasonable late fee AND attorney's fees and court costs. (ARS-33-1368 B).
