Question: My husband and I rent a home with my husband's two friends and 4 of us are on the lease, but one of his friends girlfriend is living in our home and is not on the lease and she is disrespectful and causes problems how can we legally evict her?

Answer: Failure to pay rent or violation of a lease agreement allows the landlord to being a formal eviction process. The tenant must be provided with formal notice the she is in violation of the lease agreement or has failed to pay rent on time. One business day after the expiration of the notice, the landlord may file with the Superior Court for a forcible detainer. At this point court proceedings will begin for the legal eviction process.
