Foreclosure
questions & answers
Question: Can my lanlord come after me for the money if i break my lease early, and the house is in foreclosure?
Answer: The short answer is probably yes. Tenants have some protections from being evicted following foreclosure for a period of time, but there is no protection in Arizona that allows a tenant to leave early if a house is in foreclosure (likely partly because it can be taken out of foreclosure at any time before it is actually foreclosed). Barring other bases to terminate the lease early (shutting off utilities, rendering the house uninhabitable, etc.), you may still be liable for unpaid rent for leaving early even in the case of a house in foreclosure.
