Question: Can an apartment deny a future tenant a lease due to pending criminal charges (misdemeanor)?
Answer: It is unlawful for a landlord to choose not to rent a dwelling to a prospective tenant on the basis of that tenant’s race, color, national origin, religion, sex, family status, or mental or physical disability. However, a landlord may refuse to enter into a rental agreement with a prospective tenant for other reasons, including alleged criminal activity.
