Landlord and Tenant Rights and Responsibilities
questions & answers
Question: My landlord of the apartment complex has made everyone aware that we won't have hot water for a month and a half, and they'll take $100 off rent. Is that legal?
Answer: Arizona law requires that residential landlords provide their tenants with “reasonable amounts of hot water at all times” and “do whatever is necessary to put and keep the premises in a fit and habitable condition” (A.R.S. 33-1324). If you and your landlord have an existing rental agreement that will cover the month and a half during which your landlord says there will be no hot water, then you would be wise to speak with an attorney, especially before you take any money from the landlord or sign any papers.
