Landlord and Tenant Rights and Responsibilities
questions & answers
Question: If I already gave my deposit and first month rent but haven’t signed contract can I get it back even if landlord says no refund
Answer: As a general rule, a tenant must enter into a rental agreement with a landlord before the landlord may hold the tenant responsible for fulfilling the terms of that rental agreement. If a tenant pays a deposit and rent before they sign a written contract, then they may have a right to back out, but enforceable agreements are not always in writing. If you ask your landlord to return your money but they refuse, then you may wish to obtain legal advice.
