Question: I live at XXXX apartments and since Friday before 5 pm the apartment building I live in doesn't have running hot water and maintenance to us to wait until monday then Saturday morning we called back they said corporate was working on it and still no hot water and from my understanding they have 24 hours to fix this problem. Most of the tents are essential workers that work weekends and holidays and need to shower for work for example I work at a hospital I need to shower before and after because I dont want to expose my family and baby we pay rent even when theres a crisis world wide.
Answer: I'm very sorry to hear about your situation. The landlord is required to provide hot water pursuant to A.R.S. 13-1324(A)(6). A.R.S. 13-1364 provides your remedies in the event of the landlord's failure to do so. I have pasted a link below to the Arizona Residential Landlord Tenant Act, but in short, your options under -1364 are: 1. Get your own hot water through the utility or otherwise and deduct from rent. 2. Recover damages for the diminished value of the unit. 3. Get substitute housing until service is restored and don't pay rent until it is. Written notice is required pursuant to A.R.S. 33-1364(H) before taking any of these actions. Alternatively, you can give 5-day written notice under A.R.S. 33-1361 and terminate the lease if the issue is not remedied.
