Landlord and Tenant Rights and Responsibilities
questions & answers
Question: I rented my houseout Nov 15 2008, and the rental agreement expires on Nov 15th 2013, Is it legal for the tenants to give me a 30 day notice of termination of rental agreement? What do I need to do? What is the law for that?
Answer:
You may want to consult with an attorney to see how the laws apply to your specific situation. The following is general landlord/tenant information.
You may want to review the article on this site titled, "Arizona Residential Landlord and Tenant Act." The Arizona Residential Landlord and Tenant Act contains the laws that govern the landlord and tenant relationship. The Act is located in the Arizona Revised Statutes (A.R.S.), Title 33, Chapter 10, beginning with A.R.S. § 33-1301.
A.R.S. § 33-1314 discusses the terms of the rental agreement.
A.R.S. § 33-1313 contains information about when notice is given.
A.R.S. § 33-1375 discusses termination of leases. That statute states:
A. The landlord or the tenant may terminate a week-to-week tenancy by a written notice given to the other at least ten days prior to the termination date specified in the notice.
B. The landlord or the tenant may terminate a month-to-month tenancy by a written notice given to the other at least thirty days prior to the periodic rental date specified in the notice.
