Question: We began renting a place in Feb. It was advertised as having both a swamp cooler and A/C, which is one of the reasons we chose this particular place. When they came to set-up the swamp cooler it was discovered it needs to be replaced. But now they are telling us that they will not replace it because we have A/C. Are they required to fix it?
Answer: If a landlord agrees to provide swamp cooling as part of the rental agreement he must keep it in good repair. According to A.R.S. 33-1324(A)(4), "a landlord shall maintain in good and safe working order and condition all electrical, plumbing, sanitary, heating, ventilating, air-conditioning and other facilities and appliances, including elevators, supplied or required to be supplied by him."
