Landlord and Tenant - Mobile Home Parks

questions & answers

Question: What are the rules about dogs in Over 55 mobile home parks. I live in a no pet park and now all kinds of dogs are arriving. Do they need vet certificate? Dog barking is unbearable.

Answer: If, when you entered into your rental agreement with the landlord, you were explicitly told that the mobile home park was a pet-free park, then you should have been provided with advance notice of any change to that policy by the landlord (A.R.S. 33-1436). As to the barking, under the Arizona Mobile Home Parks Residential Landlord and Tenant Act (A.R.S. Title 33 Chapter 11), every mobile home park tenant is required to “conduct himself and require other persons on the premises with the tenant’s consent to conduct themselves in a manner that will not disturb the tenant’s neighbors’ peaceful enjoyment of the premises” (A.R.S. 33-1451). A tenant whose neighbor is failing to meet this obligation can always deliver to the landlord a signed and dated letter describing the problem in detail (loudness, frequency, time of day, etc.) and requesting that the landlord ensure that the neighbor complies with the law.
