Question: I HAVE A JUDGMENT AGAINST AN INDIVIDUAL AND I WANT TO GET AN ABSTRACT ISSUED TO RECORD AGAINST THE INDIVIDUALS PROPERTY IN ARIZONA. DO I NEED TO GET A SPECIAL ABSTRACT ISSUED OR CAN I USE THE CALIFORNIA ABSTRACT ISSUED?
Answer:
In order to obtain a judgment lien with an out-of-state judgment, an out-of-state judgment must be domesticated in Arizona. Then an Arizona judgment can be recorded it in the County Recorder’s office of the county where the debtor lives. It will automatically attach to property. A.R.S. §§ 12-1701-1708, 33-961-968.
The rules are technical, and there are a number of costs and steps involved. You may want to speak with an attorney.
