Question: If seek special action review of a justice court's pretrial order denying a jury trial, do I file a "petition" or a "complaint"? Or are both valid?
Answer: According to Rule 4(d) of the Rules of Procdure for Special Actions a special action is initiated by filing a "Complaint" If you go to the Arizona Supreme Court website you should be able to link to an on line resource "Representing Yourself: Appealing a Civil Case to the Superior Court". Although this is designed to help with appeals, it may have some useful information in connection with a special action.
