Question: Need to file an release of order of protection. The domestic Violence charges were dropped. Never been arrested before and need my arrest record sealed.
Answer:
A plaintiff may request that an Order of Protection be dismissed or quashed at any time during the term of the order. Only a judge can dismiss or quash an Order of Protection.
To file a motion to dismiss or quash an Order of Protection, you must go to one of the Protective Order Centers to complete a motion. You will be required to provide identification to court personnel at the time you complete the Motion to Dismiss or Quash. You will be required to appear before a judge and explain why you want to dismiss the order. Please allow at least two hours for the entire process. (Maricopa County Superior Court)
Only juvenile records may be sealed, or expunged however, a record may be set aside. For more information on setting aside a judgment please review statute A.R.S 13-907 and consult an attorney.
