Question: I have completed probation. What form do I file with the court to have my class 6 undesignated felony designated a misdemeanor?
Answer: Usually people convicted of an undesignated offense in Arizona are placed on supervised probation. The supervising probation officer monitors the person’s progress or lack thereof, keeping the court informed of that person’s performance. If the person completes all terms of probation ordered by the court, then the probation officer files a petition with the court with the probation officer’s recommendation about termination of probation. If the offense is an undesignated felony offense, the probation officer includes in the recommendation whether to designate the offense a misdemeanor or a felony. Then the court makes a decision, followed by an Order.
