Question: Are scholarships considered income? My ex receives a great deal of money from scholarships and 401K cash out but claims that he has no income?
Answer: The following is provided for general information only. To find out how the law applies to a specific situation, contact an attorney directly. According to Arizona Revised Statute (ARS) 25-500(6), "Income" includes "any form of payment owed to an individual, regardless of source, including wages, salaries, commissions, bonuses, workers' compensation, disability payments, payments pursuant to a pension or retirement program and interest." Child support enforcement is handled by the Arizona Department of Economic Security, Department of Child Support Enforcement (DCSE). A child support order can be modified if the requesting party shows that there is a substantial and continuing situation which would change the order by 15 percent or more. A person who believes their case meets the criteria for modification may complete a modification packet and return it to: Modification Packet, Division of Child Support Enforcement, P.O. Box 40458, Phoenix, AZ 85067. You may also visit a local DCSE office to pick up a modification packet or contact DCSE at (602) 252-4045 or (800) 882-4151.
