Question: If the childrens father rights were terminated does his parents still have rights to them can they still ask for visitation?

Answer: According to ARS 8-539, an order terminating the parent-child relationship ends the parent’s legal rights, privileges, duties and obligations with respect to each other (with limited exceptions). Grandparents may petition for visitation rights: ARS 25-409: “D. A grandparent, a great-grandparent or a person who stands in loco parentis to a child may bring a proceeding for visitation rights with a child by filing a verified petition in the county in which the child is permanently resident or is found.”. The grandparents petitioning for visitation must prove that the visitation is in the best interests of the child in order for the court to grant the petition (ARS 25-409).
