Question: My husband is in prison for one year for hurting me. I also have a 5 year restraining order against him. Will I be able to get a divorce from him when he is in jail and has a RO.

Answer:

You can file for divorce in the same manner as you would if the person was not incarcerated.  The difference is serving them the papers.  The clerk of the court site shows how to serve through the sheriff's office. http://www.clerkofcourt.maricopa.gov/eformsondemand/112_service_gn2.pdf
