Question: What should I do if I am wrongfully accused of a serious crime on social media?
Answer: A published false statement that damages someone’s reputation is called libel or defamation. This limitation is created by common law torts that US Supreme Court and Arizona courts have long used as precedent for limitations on free speech. In order to win a defamation suit you will need to prove several things. 1. The defendant made a defamatory statement 2. The statement was False 3. Statement was said to a third person 4. Statement caused Plaintiff damages 5. Defendant knew statement was false or acted in reckless disregard of whether the statement was true or false OR negligent in failing to determine the truth of the statement For more information on what you would have to prove in court, visit: http://www.azbar.org/media/363117/proposed_civil_jury_instructions_2012.pdf
